First Seek Medical Attention

The new CPR requires parties to an action to follow pre action protocols and in the case of accident compensation cases or medical negligence cases, require extensive pre action attempts for out of court settlement. Therefore, after the evidence has been gathered, we will send a demand letter to the at-fault party or their insurance company, stating the damages you are claiming and requesting fair compensation on your behalf.

Negotiation and Settlement

The at-fault party or their insurance company may respond to the demand letter with a settlement offer. We will negotiate on your behalf to try to reach a fair settlement. This may take several rounds of negotiation before a fair sum of damages and compensation can be agreed by both sides.

Filing a Lawsuit

If a settlement cannot be reached, we will file a lawsuit on your behalf. This initiates the legal process, and the defendant insurance company has a certain amount of time to respond. We will file on your behalf the particulars of your claim in court and these documents outline your case and the compensation you’re seeking. These will be served to the defendant insurance company who has then a deadline to file a defence.

Court Case Management

Thereafter both parties will assist the court in managing the case efficiently and there will be a Case Management Conference where a judge may hold a conference to set a timetable for the exchange of evidence and to give directions regarding the future conduct of the case. The parties will engage in pre-trial preparations which involves exchange of evidence, documents and expert reports as directed by the court and perhaps exchange witness statements prepared by both sides.

Trial and Judgment

During trial both sides present their cases, including evidence and witness testimonies and the judge decides based on the presented evidence and legal arguments. The judge will issue a verdict and determine the amount of damages to be awarded.

Appeals

Either party may file an appeal if they disagree with the verdict.
