If I happen to trip and get injured on someone else’s property, can I claim compensation for my injuries?
Yes, if you have suffered injuries on someone else’s property you can claim compensation. To receive compensation you must be able to prove that:
1. The accident took place on the premises of a third party due to his negligence.
2. That the owner or occupant knew or should have known that a dangerous condition existed on his premises and that he could have taken reasonable precautions to prevent that condition and failed to do so.
What kind of accidents can I be entitled to compensation for?
You can be compensated for accidents that take place on a third party’s premises due to that third party’s negligence and/or failure to keep their premises free of danger to their visitors.
Examples include situations where an object falls from a height resulting in injury, wet or slippery floors, damaged furniture, dangerous stairs, unmaintained walkways, potholed sidewalks, inadequate lighting, construction sites without warning signs, and more.
What should I do if I suffer such an injury?
If you were injured on third party property you should do the following:
1. Get medical treatment right away: Even if your injuries don’t seem serious, you should see your doctor to make sure you’re okay and to have your injury documented with medical evidence.
2. Photograph the accident scene: Make sure you take a clear picture of your accident scene and anything that led up to your accident before anyone even thinks about fixing the problem.
3. Don’t sign anything: The owner or their insurance company may seek a waiver. Do not sign anything until you consult with your attorney.
