Can I Claim Compensation for Bodily Injuries in Cyprus if I am Also Partly to Blame for my Pedestrian Accident?

Yes you can.

Under Cyprus law, if you are partly to blame for your pedestrian accident, this is known as contributory negligence. In such cases, the amount of compensation you receive will be reduced to reflect your share of the blame.

This is a favourite strategy for insurance defence lawyers in Cyprus. Very rarely insurance companies will resist from claiming that an injury victim was contributory negligent. Advocates for the insurance company will more often than not argue that the injured person was also at fault.

In order to prove contributory negligence under Cyprus law, insurance defence lawyers must be in position to prove:

 - That there was a failure on the part of the injured claimant to take reasonable care for their own safety;

 - That this failure caused or materially contributed to the injury; and

 - That harm to the claimant was reasonably foreseeable.

The percentage of contributory negligence is determined on a case-by-case basis, taking into account factors such as, the circumstances of the accident, and the extent to which each party was responsible.

For example, if the court finds that you are 30% responsible for the accident, and the total compensation would have been €10,000, your compensation will be reduced by 30% to €7,000.

It is advisable to seek the assistance of an experienced personal injury lawyer who can advise you on the best course of action to take and help you negotiate a fair settlement with the other party or their insurance company.
